Five has throughout its existence adopted a policy of negotiating potential developments and commissions on a case by case basis in a flexible, fair, reasonable and non-discriminatory manner and will continue to do so in the future. This Code of Practice has been drawn up in order to comply with the obligation imposed on Five pursuant to Section 285 of the Communications Act 2003 and sets out the fundamental principles which Five will adhere to in all of its dealings with independent producers.

This agreement is the basic production agreement, including agreed definitions and approved Video-on-Demand business models and remuneration formulae settled with Pact in April 2010, and as such represents Channel 5’s terms of trade in relation to the commissioning of programmes for its services. Both Channel 5 and the Producer are entitled to use this as a guideline or to seek to vary the terms as they may negotiate subject to the principles set out in Channel 5’s Code of Practice.

The launch of Five’s VOD services for commissioned programmes follows agreement reached between Five and PACT in 2007 about the way in which Producers should be remunerated for VOD rights.
