Big Brother Vote Terms & Conditions
1. The Big Brother Vote (the "Vote") is organised by or on behalf of Channel 5 Broadcasting Limited of 10 Lower Thames Street, London, EC3R 6EN ("Channel 5"). By participating in the Vote you agree to be bound by these terms and conditions (“Terms”).
2. You will be able to cast your vote by premium rate telephone call or via Facebook. It is not possible to vote using SMS. Please note that the cost of each vote may vary according to your method of voting. Please see the sections below for the specific terms which apply to each method of voting.
3. Voting is intended for viewers watching the show in the UK. Responsibility cannot be accepted for any vote services promoted outside the UK and Channel Islands as these are not within our control. Channel 5 reserves the right to disallow votes if they have reasonable grounds to suspect they have been made from outside the UK (and Channel Islands).
Premium Rate Phone Calls
4. Each call is worth one vote, and will cost 36 pence from a BT landline. Calls from other networks may be higher and calls from mobiles will cost considerably more. Please check with your network operator or mobile provider before calling for exact call charges.
5. You may vote as many times as you like but the eligibility of any vote is at the sole discretion of Channel 5.
6. If you are not the bill payer, you must get permission from the bill payer before calling to vote.
7. At times you may not be able to get through to register your vote. Channel 5 is not liable to callers who are unable to register a vote.
8. Arrangements have been put in place which are designed to ensure that no-one will be charged for votes cast outside of the voting windows. Please contact your network provider or Channel 5 if you believe you have been charged for a call made outside of the voting window.
Facebook App
9. To vote using Facebook you will need to allow the Big Brother Facebook application (“Facebook App”) access to your Facebook Account.
10. In order to vote you will first need to purchase Facebook Credits. The Big Brother Facebook page will direct you to the Facebook Credit purchasing process. Once you have purchased Facebook Credits, you will be able transfer these into Big Brother voting credits on the Big Brother Facebook page.
11. Payment for credits will be made through Facebook, and charges will be applied to your Facebook account in accordance with Facebook’s terms of use.
12. Five voting bundles will be available; 1 vote for 1 Facebook credit, 12 votes for 10 Facebook credits, 24 votes for 20 Facebook credits, 50 votes for 40 Facebook credits and 100 votes for 80 Facebook credits. You are limited to 200 votes in your wallet at any one time and you can spend up to 500 Facebook Credits per week (Saturday to Friday). You can vote up to 500 times per Vote Window. In the final week (“vote for your winner”) the Facebook credit purchase cap will remain but the vote cap will be lifted to allow you to use any remaining votes in your wallet. Remember that your votes MUST be used prior to the end of the series as they are non-refundable and non-transferable.
13. Big Brother voting credits are non-transferable and non-refundable and are only valid for the 2012 series of Celebrity Big Brother.
14. In order to cast your vote, you need to click the ‘Vote’ button next to the housemate you would like to vote for. The ‘Vote’ button will only be accessible on housemates up for eviction, during the voting period.
15. Each time you successfully purchase Big Brother voting credits your credit tally at the top of the page will update to reflect your new balance.
16. Please note that when you purchase credits via Facebook, any rights you may have to withdraw from or cancel your purchase (including but not limited to under the Consumer Protection (Distance Selling) Regulations 2000) will be lost because the performance of our services begins immediately once your purchase is completed.
General
17. The opening and closing times of the Vote are all as advertised on the Channel 5 programmes ‘Big Brother’, ‘Big Brother’s Bit on The Side’, and on the website [channel5/bigbrother]. Votes cast outside of these times will not be counted but may be charged. Voting closes during the ‘Big Brother’ Eviction programme. Please watch the programme for the exact closing time of the Vote. The results of the Vote will be announced during the ‘Big Brother’ Eviction programme.
18. Channel 5 reserves the right to disallow votes if it has reasonable grounds to suspect that fraudulent bulk votes have been cast (i.e. more votes than a human being could possibly submit in the time available without the use of software or other devices designed to make automated votes).
19. Channel 5 is committed to operating a fair and consistent voting system. Please note that Channel 5 are unable to confirm the integrity of any other voting method except for the official voting systems as outlined in these Terms.
20. Channel 5 may amend, suspend, withdraw, cancel or re-set the Vote for any reason at its sole discretion and at any time.
21. All votes are monitored by Electoral Reform Services.
22. Channel 5's decision in relation to all matters affecting the Vote is final.
23. Under no circumstances will there be a refund for any vote cast or for any misdialled calls.
24. Channel 5, its group companies and sub-contractors do not accept any responsibility whatsoever for any technical failure or malfunction or any other problem in any telephone network or line, system, server, provider or otherwise which may result in any vote being lost or not properly registered or recorded. To the fullest extent permitted by law, Channel 5 hereby excludes all warranties, representations, covenants and liability (whether express or implied) regarding the Vote.
25. Facebook, Apple and Android are not sponsors nor are they involved with Big Brother, Channel 5 or Endemol UK Limited in any way. Facebook, Apple and Android are not responsible for the content of Big Brother nor does it have any authority over events within the show.
26. Any personal data collected will be used solely in connection with current UK data protection legislation. Please see Channel 5's Privacy Policy for further details.
27. Channel 5 reserves the right to amend these Terms and Conditions without prior notice. Any changes will be posted on this website and such posting shall be adequate notice to all participants. Please check these Terms and Conditions each time you wish to vote.
28. These Terms and Conditions shall be governed by English Law.
